Terms of service
Terms of Service
These Terms govern business purchases and use of the Lead Reclaimer service.
Last updated: October 21, 2026
Effective date: October 15, 2026
1. Agreement and business eligibility
These Terms form an agreement between you and Jordan Boyce, sole trader, trading as Lead Reclaimer. By purchasing, accessing or using the service, you agree to these Terms and the policies incorporated into them.
The service is offered only to customers acting for US membership-based gyms. You confirm that you have authority to bind the business you represent and that you are not purchasing as a consumer.
2. Operator and contact details
The operator is Jordan Boyce, sole trader, trading as Lead Reclaimer.

3. The service
For purchases on or after October 15, 2026, one purchase is one $299 USD payment for one managed recovery lasting 30 calendar days, including weekends. You may upload and review up to 500 rows of your business's own historical leads. Only the verified eligible subset that fits mailbox safety is scheduled, with at most 300 leads for the full three-message sequence and up to 900 total messages. Actual sending is subject to replies, suppression, mailbox health and delays. Remaining eligible leads stay in the Lead Library and are not sent in this purchased recovery. “New” means newly added to that recovery intake, not newly acquired prospects. The purchase is not a subscription and does not renew automatically.
Sending is limited to 30 messages per day, including follow-ups, between 10:00 and 17:00 in the connected mailbox's timezone, with at least 14 minutes between messages. These limits do not promise that every uploaded lead will be contacted or every scheduled lead will receive all three messages.
Purchases before October 15, 2026 retain the service duration and refund terms in effect when purchased, including the agreed 14-day duration where applicable. This prospective update does not change the terms of an already purchased historical run.
Lead Reclaimer prepares a three-message email sequence for your review and approval before sending begins from your connected business mailbox. Later follow-ups stop after a detected reply or unsubscribe request. The service does not include bought, rented or scraped leads, SMS outreach or markets outside the United States.
Lead Reclaimer does not guarantee replies, appointments, trials, memberships, revenue, return on investment, deliverability, inbox placement or uninterrupted availability. This does not limit the Reply Guarantee described in our Refund Policy.
4. Account, mailbox and security responsibilities
Connect an eligible Google Workspace or Gmail mailbox. Custom business domains are supported when hosted by Google.
You need 2-step verification, the ability to generate a Google app password, and permission for SMTP and IMAP access. Organizational restrictions may prevent connection, so compatibility is not guaranteed. Microsoft, Outlook and other non-Google mailboxes are not supported at launch.
Create an app password on Google's secure page, then enter it in Lead Reclaimer after onboarding verification. We never ask for your normal Google password. An app password still grants mail access and can be revoked in your Google account. Do not provide mailbox credentials before payment.
Before purchasing, check the current mailbox address in the product purchase flow and confirm: “I can create a Google app password for this mailbox, and my account allows SMTP and IMAP access.” The address must be identified as supported and hosted by Google. A manual confirmation or failed domain lookup does not bypass this check. This setup requirement does not change the refund rights in section 8.
- Provide complete, current and accurate account and business information.
- Keep access links, credentials, devices and connected mailbox access secure.
- Use a supported mailbox that your business is authorized to connect and operate.
- Tell us promptly about suspected unauthorized access or a compromised mailbox.
- Remain responsible for activity performed through your account by people you authorize.
The generally available connection still uses a Google app password with SMTP and IMAP through Smartlead. Google OAuth is limited to accounts where it is enabled; it is not generally available and is not represented as Google verified. Existing purchase compatibility checks and app-password requirements remain unchanged.
Where Google OAuth is enabled for your account, Google's permission flow connects the intended Google Workspace or Gmail mailbox. You must own or be authorized to connect and operate that mailbox. Lead Reclaimer does not request your normal Google password or a Google app password for this OAuth connection.
5. Customer warranties and responsibilities
You represent and warrant that:
- You own or control the uploaded records and have authority to provide and use them.
- You have a lawful basis and have provided any notices or obtained any permissions required for the intended outreach.
- Your sender identity, business identity, physical postal address and campaign content are accurate and not misleading.
- Your records are your own first-party historical leads and are not scraped, purchased, rented, harvested or otherwise unlawfully obtained lists.
- You own or are authorized to control the sending mailbox and address.
- You will not submit anyone who has opted out, withdrawn consent where relevant, or otherwise should not be contacted.
- You are responsible for the campaign content you approve and the recipients you select.
- You will not upload intentionally sensitive or special-category personal data.
6. Commercial email compliance
You must comply with applicable commercial email, privacy and consumer-protection laws. This includes using accurate routing information, headers and subject lines, clearly identifying advertising where required, including a valid physical postal address, and honoring opt-out requests promptly.
Lead Reclaimer may preserve suppression records and may pause, limit or stop any send that appears unsafe, unlawful, deceptive or inconsistent with these Terms or the Acceptable Use Policy.
7. Fees and taxes
The fee is $299 USD for each recovery. Prices are shown before checkout. You are responsible for taxes, duties or similar charges that apply to your purchase, except taxes based on Lead Reclaimer's income. Payment processing is provided by Stripe under its applicable terms.
8. Refund policy
Our Refund Policy is incorporated into these Terms. It includes the conditional Reply Guarantee for eligible purchases and completed runs.
Before sending starts
You may request a full refund by emailing hello@leadreclaimer.com. To qualify as a pre-send request, your email must be received before the first recovery email is submitted to the sending provider. Payment, outreach approval, connecting a mailbox, or placing an internal job in a queue does not by itself end this right. We use the time your request is received, not the time support reads or processes it. A recovery email already submitted to the sending provider cannot be recalled.
If Lead Reclaimer cannot start the service for a reason within its control and the first recovery email has not been submitted to the sending provider, you may choose either another attempt to start the recovery or a full refund. We review and submit pre-send refunds within the timelines below. A processing delay by support does not make a timely pre-send request ineligible.
The Reply Guarantee
For a paid $299 recovery purchased on or after October 4, 2026 while the Reply Guarantee is advertised, Lead Reclaimer will refund the full $299 if an eligible completed run has fewer than 2% unique genuine human replies. This is a launch offer. We may change or withdraw it for future purchases only. The terms in effect when you purchase will remain honored for that purchased run, even if the offer is later changed or retired.
Eligibility
An eligible run must meet all of these conditions:
- At least 250 unique first-party historical leads are successfully contacted during that recovery run. Uploaded or selected leads, and total emails sent, do not determine this minimum.
- You review and approve the outreach, keep an authorized mailbox connected, and allow the approved recovery to reach its scheduled end. This means you do not voluntarily cancel or stop the run early or disconnect mailbox access in a way that prevents completion.
- Your records and use comply with the lawful-list requirements in our Acceptable Use Policy.
The contact minimum never permits sending merely to reach 250, bypassing safety or suppression controls, or contacting people who opted out. Normal stopping of follow-ups for a lead who replies, opts out, bounces, or is suppressed does not make the whole run incomplete, and each lead does not need to receive all three messages. A temporary pause does not by itself make a run ineligible if sending resumes and the approved recovery still completes by its scheduled end.
An automated safety pause or a service or provider interruption does not remove your pre-send, service-failure, or statutory refund rights. If an interruption prevents the run from reaching its scheduled end, contact support for the service-failure remedy described below. A genuinely incomplete run does not automatically qualify under the Reply Guarantee, but it is not automatically a blanket forfeiture of other refund rights.
Completed run and counting window
For purchases on or after October 15, 2026, a “completed run” is the approved 30-calendar-day recovery, including weekends, reaching its scheduled end. Purchases before October 15, 2026 retain their agreed service duration and the refund terms in effect when purchased, including the 14-day duration where applicable. This update does not change those historical purchased runs. A run is not completed merely because all uploaded leads have been considered or the final follow-up has been sent. The counting window begins when the first actual recovery email in that run is successfully sent and closes at the run's scheduled end. A reply received at that cutoff counts; a reply received later does not. All leads share the same scheduled run end. This does not promise a separate 30-day window, or a separate historical-duration window, for every recipient.
Purchase, setup, and approval dates do not start the reply window. An early stop or an incorrect status label does not shorten the scheduled measurement window. We verify the scheduled cutoff and actual send and receipt timestamps from relevant campaign, mailbox, and provider records. The calculation supplied for a claim will state the start, scheduled end, and timezone used. A dashboard “launched” or “completed” timestamp is not necessarily the event that controls this calculation.
How unique contacted leads are counted
For the manual guarantee review, a unique lead means one distinct recipient email address. We trim surrounding spaces and compare addresses without regard to uppercase or lowercase letters. Repeated rows, messages, and follow-ups to one address count once. A shared email address counts as one recipient, not several people, and records for the same underlying lead must not be split artificially to increase either count. This is a review rule and is not a claim that normalization is automated.
Each purchased run is assessed separately. Leads and replies cannot be pooled across recoveries. Uploaded or selected records and total messages do not establish the contacted count.
Successfully contacted leads
“Successfully contacted” means the provider record confirms that the lead's first recovery email was sent, not merely selected, queued, attempted, or submitted. A provider sent record is not proof of inbox delivery, an open, or inbox placement, and none is guaranteed.
A confirmed failed delivery or bounce of that initial email excludes the lead from both the contacted count and reply count. A temporary delivery delay later confirmed as successful is not a final failure. If a genuine reply reliably establishes that the initial email was received, a later follow-up bounce does not erase that contacted lead or reply. A lead who unsubscribes after a successful first send remains in the contacted count, but a click-only unsubscribe is not a reply. If delivery exclusions leave fewer than 250 successfully contacted leads, the Reply Guarantee minimum is not met. Other refund rights remain intact.
Genuine human replies
A qualifying reply is a genuine inbound human response to the recovery from an eligible successfully contacted lead during the counting window. Each lead counts once regardless of how many replies they send or their sentiment. A negative or not-interested response and a human-written opt-out request count. A reply does not need to show interest, produce a booking, or lead to a positive outcome.
A response from a different address counts only when reliable records match it to the original contacted lead or conversation, and it cannot also count as a second recipient. Automatic or out-of-office messages, bounces, and click-only unsubscribes do not count. Test or seed events, responses created by the customer or its staff, and fabricated or collusive events are not genuine historical-lead responses and cannot increase either count.
Evidence and timing of replies
The received timestamp in the connected mailbox or provider record determines whether a reply arrived in the counting window. A delay before the reply appears in Lead Reclaimer, a webhook delay, or later classification does not change that time. An event that arrived within the window but synchronized later will count after verification. A reply received after the scheduled cutoff does not count.
We manually review relevant provider and mailbox records. A missing Lead Reclaimer log is not by itself a reason to exclude an event when other reliable evidence verifies it. The workspace's “Interested,” “Recovered,” or all-replies totals do not decide guarantee eligibility, and the workspace does not automatically calculate eligibility or issue a refund. You may challenge a count using redacted dates or message headers. You do not need to send raw lead lists, passwords, access links, or card details.
Exact calculation
The reply rate is R divided by D, multiplied by 100. R is the number of qualifying genuine-human replying leads, and D is the number of unique successfully contacted leads in that run. We use the exact, unrounded result. A rate strictly below 2% qualifies; exactly 2% does not. We do not round 1.99% up to 2% or combine counts from different runs.
Four qualifying replies from 250 successfully contacted leads is 1.6% and qualifies for a refund. Five from 250 is exactly 2% and does not. Five from 300 is 1.666...% and qualifies. Six from 300 is exactly 2% and does not.
How to make a claim
After the run is complete, email hello@leadreclaimer.com from the account email where possible. If you cannot access that email, we will offer a reasonable way to verify your identity rather than automatically reject the claim. Include your business name and recovery reference if available. A missing reference is not by itself a reason to reject a claim. This policy adds no shortened claim-filing deadline; applicable legal time limits still apply.
We will explain the record basis for the decision, any eligibility condition not met, the contacted and reply counts, the exact unrounded rate, and the start, scheduled end, and timezone used. We will resolve disputed or missed genuine replies using the evidence rules above. The decision is not treated as unchallengeable, and legitimate dispute rights are preserved.
Review and refund timelines
Within five business days after receiving a claim, we will send the decision and calculation or identify specific information reasonably necessary to verify identity, the purchase, or relevant sending or reply evidence. If information is needed, we will explain exactly what is missing and complete the review within five business days after receiving it. We will not request arbitrary or unnecessary documents, and we will not delay solely because our own dashboard or logs are missing when other reliable evidence verifies the events.
Once a refund is approved, we will submit the full $299 refund to the original payment method within two business days. The payment provider or bank controls when the money arrives after submission. If the original payment method cannot accept the refund, we will explain the issue and use a lawful, verified alternative supported by the payment provider. This does not automatically remove the refund right, and we will not ask for sensitive card details.
“Business days” means Monday through Friday, excluding US federal holidays, calculated using UTC. The receipt or approval date is day zero. The next qualifying business day is day one, and a deadline expires at the end of the relevant day in UTC. This definition applies to every support and refund deadline stated in this policy.
Only one full refund is available for a purchase, with no fee deducted from the $299. A purchase already refunded or reimbursed through a payment dispute does not qualify for a duplicate reimbursement. This refund does not cover consequential losses or independent third-party fees.
Other refund rights and limits
After sending starts, refunds remain available where Lead Reclaimer cannot materially provide the purchased service or applicable law requires one. Provider involvement does not by itself remove an applicable service-failure remedy or an express refund obligation. After the first email is submitted for sending, there is no refund solely because you change your mind, receive little interest, do not obtain bookings or sales, or do not meet the Reply Guarantee conditions. This does not affect the Reply Guarantee, refunds for material service failure, or rights that cannot lawfully be excluded.
The Reply Guarantee is a refund promise. It does not guarantee sales, memberships, trials, appointments, revenue, positive replies, deliverability or inbox placement. Nothing in this policy limits rights that cannot lawfully be excluded. This shared policy governs the Reply Guarantee. Service, warranty, liability, third-party, or force-majeure terms do not cancel its express refund obligations.
9. Acceptable use
The Acceptable Use Policy is incorporated into these Terms. A breach of that policy is a breach of these Terms.
10. Third-party services
The service relies on third-party services for payment, hosting, email delivery and connected mailbox functions. Their availability and separate terms may affect the service. Smartlead is a behind-the-scenes Lead Reclaimer email-delivery provider for the existing app-password route, not a separate product you buy or administer. You enter a Google app password in Lead Reclaimer after onboarding verification for that mailbox connection. Where Gmail Direct OAuth is enabled for an account, its OAuth tokens are not sent to Smartlead. The current provider categories are described in the Subprocessors list. Lead Reclaimer is not responsible for failures caused solely by third-party systems outside its reasonable control, but this does not override our express refund obligations under section 8 or remove obligations that cannot lawfully be excluded.
11. Suspension and termination
Lead Reclaimer may pause, suspend or terminate access where reasonably necessary to address suspected unlawful activity, security risk, abuse, non-payment, policy breach, provider restrictions or material risk to recipients, customers or the service. Where appropriate, we will give notice and an opportunity to correct the issue.
Enforcement under the Acceptable Use Policy may be immediate and without prior notice. You may stop using the service at any time. A verified account-deletion request stops provably unsent work. Termination does not undo amounts already due, completed processing, suppression obligations or provisions intended to survive termination.
12. Customer data, confidentiality and privacy
As between the parties, you retain your rights in customer data. For the historical-lead recovery campaign only, you and Lead Reclaimer are joint controllers under the Recovery Joint Controller Arrangement, which is incorporated into these Terms for that campaign. You remain the sole controller of your source CRM or list before transfer and of your post-reply sales records. Lead Reclaimer is the controller for account, billing, security, audit, support and website analytics data. Each party will protect the other's non-public confidential information and use it only for the agreement, except where disclosure is required by law.
Our Privacy Notice explains how personal information is handled.
13. Intellectual property and feedback
Lead Reclaimer and its licensors retain all rights in the service, brand, software, design and materials. Subject to these Terms, you receive a limited, non-exclusive, non-transferable right to use the service for your internal business purposes during the purchased recovery.
If you provide feedback, you allow Lead Reclaimer to use it without restriction or payment, provided we do not identify you publicly without permission.
14. Warranty disclaimer
To the fullest extent permitted by law, the service is provided "as is" and "as available." Lead Reclaimer disclaims implied warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms excludes a warranty that cannot lawfully be excluded. These disclaimers do not override our express refund obligations under section 8.
15. Liability
To the fullest extent permitted by law, Lead Reclaimer is not liable for indirect, incidental, special, exemplary or consequential loss, or for loss of profits, revenue, goodwill, business opportunity or data, arising from the service.
Lead Reclaimer's total aggregate liability arising from or relating to an affected recovery will not exceed the amount you paid for that recovery. Nothing in these Terms limits or excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited or excluded. This section does not reduce or override our express refund obligations under section 8.
16. Customer indemnity
You will indemnify and hold Lead Reclaimer harmless from third-party claims, damages, costs and reasonable legal fees arising from unlawful customer data, content, instructions, recipient selection or use of the service, except to the extent caused by Lead Reclaimer's breach of these Terms or applicable law.
17. General terms
Force majeure
Neither party is liable for delay or failure caused by events beyond its reasonable control. This does not override an express refund obligation under section 8 or a right that cannot lawfully be excluded.
Assignment
You may not assign this agreement without our prior written consent. We may assign it as part of a business transfer or reorganization, provided your rights are not materially reduced.
Severability and waiver
If a provision is unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver.
Entire agreement
These Terms and incorporated policies are the entire agreement about the service and replace earlier discussions or representations about it.
Changes
We may update these Terms for legal, security or service changes. The current version and effective date will be posted here. Material changes will apply prospectively and notice will be provided where required.
Notices
Notices to Lead Reclaimer must be sent to the email or postal address above. We may send notices to the account email you provide.
18. Governing law and courts
These Terms and any non-contractual dispute are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, subject to any rights or rules that applicable law does not permit the parties to exclude.
